Terms of sale

1. Vendor Identification

These general terms and conditions of sale apply to the sales defined below and carried out by PARESSE PARIS, a limited liability company with share capital of €10,000, whose registered office is located at 66 Avenue des Champs Élysées - 75008 Paris - France, registered in the Paris Trade and Companies Register under number 929 041 622. Its Siret number is 929 041 622 000 10 and its VAT number is FR 169 290 41622.

 

2. Scope of Application and Acceptance of Terms and Conditions

The purchase of products offered on the www.paresseparis.com website (hereinafter the "Site") and/or by telephone is subject to the present terms and conditions of sale ("Terms and Conditions").

The Site enables you to order a selection of PARESSE PARIS brand products (hereinafter the "Product(s)") from PARESSE PARIS online via the Internet.

PARESSE PARIS Products are exclusively intended for sale to end consumers, whether natural persons or legal entities, to the exclusion of all resellers or intermediaries acting on behalf of resellers. Consequently, the customer declares that he/she is acting as a final consumer and that he/she has no intention of reselling, directly or indirectly, the PARESSE PARIS Products for commercial purposes, this commitment being an essential condition for PARESSE PARIS.

The customer certifies that he/she has the legal capacity to enter into the commitments provided for herein.

PARESSE PARIS may update these General Terms and Conditions of Sale at any time. You can check the current version of the General Terms and Conditions of Sale at any time by visiting the "General Terms and Conditions of Sale" section of the Site.  The contract of sale between you and PARESSE PARIS will include the terms and conditions of your order and the terms and conditions of sale applicable at the time of your purchase, which apply to the exclusion of any other terms and conditions or any implied terms of trade, customer or business practice.

In addition, each time you make a purchase on the Site, you will be asked to confirm your acceptance of these General Terms and Conditions of Sale in force on the date your order is placed. These terms and conditions can be viewed before and at the same time as you are asked to confirm your acceptance of them. To confirm your acceptance, you must tick the box "I accept the General Terms and Conditions of Sale (new window), and consent to the processing of my data in accordance with the PARESSE PARIS Privacy Policy". You can consult the PARESSE PARIS Privacy Policy at any time by clicking on the link entitled "Personal Data".

 

3. Ordering Information

If you have any questions about the Products or your orders, you can contact our customer service department (hereinafter "Customer Service") by clicking on the "Contact Us" link, Monday to Friday (excluding public holidays), from 10am to 6pm.

The Site allows you to order a selection of Products online via the Internet from PARESSE PARIS for delivery under the conditions specified in article 8.1 "Delivery zone".

You can also order by telephone by contacting our Customer Service department.

The Site does not allow the placing of special orders which consist in particular in the creation of a Product which does not exist or no longer exists in the PARESSE PARIS collection, or in the adaptation/modification of a Product from the PARESSE PARIS collections by PARESSE PARIS. The present General Terms and Conditions of Sale therefore do not apply to special orders. For all special orders, please contact our Customer Service department by clicking on the "customer service" link, Monday to Friday (excluding public holidays), from 10am to 6pm.

However, the present General Terms and Conditions of Sale will apply to any purchase of personalized products at your request (see article 4.2 below).

 

4. Product Availability

4.1 Provisions specific to Pre-orders

Pre-ordering refers to the possibility for the customer to reserve certain Products indicated on the Site before their release date (hereinafter the "Pre-order" or the "Pre-ordered Product").

4.2 Provisions specific to Customization

Personalization refers to the possibility for the customer to adapt or personalize certain Products from the PARESSE PARIS collections (hereinafter the "Personalization" or the "Personalized Product").

4.3 Product availability

Product offers are subject to availability. In fact, at the time of order validation, there may be a difference between the stock available electronically and the existing physical stock (for example, in the case of simultaneous orders of the same product by several customers). The sale is therefore subject to the availability of Products in stock. Furthermore, PARESSE PARIS reserves ownership of the Products until payment has been received in accordance with the provisions of article 7 below.

The availability date of a pre-ordered Product will be expressly indicated on the product sheet. In the event of a change in the availability date, you will be informed immediately by email and/or on your customer account.

In the event that a Product is unavailable after you have placed your order, we will inform you by e-mail or telephone as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order.

PARESSE PARIS accepts no liability in the event of Products being out of stock or unavailable.

PARESSE PARIS reserves the right to change the Products offered on the Site and/or by telephone at any time and without prior notice.

In order to ensure a better quality of service and availability of our Products to all its customers, PARESSE PARIS reserves the right to limit the quantity of Products that may be purchased by a customer, in accordance with the provisions applicable in this respect and in particular those of Article L. 121-11 of the French Consumer Code.

 

5. Ordering Procedure

5.1. Order procedure on the Site

5.1.a) Product selection

You can add Products to your selection at any time by clicking on “Add to cart”.

You can consult your selection by clicking on “Basket” in the top menu, where you will see: the photo(s) of the Product(s), its color(s) and reference(s), the quantity(ies) chosen, its/their unit price(s) and the subtotal of the selection.

5.1.b) Identification

Once you have selected the Product(s), click on “Order” to start the ordering process.

A customer account is required to place an order on the Site:

If you already have a customer account, you will need to log in at this stage by entering your password.

If you don’t have an account yet, you’ll be prompted to create one by confirming your e-mail address and creating a password later.

Your login and password are strictly personal, and you therefore undertake to keep them securely and never to pass them on to third parties. In the event of loss, theft or any fraudulent use of your customer account, you undertake to inform PARESSE PARIS immediately.

Creating an account allows you to :

  • track your deliveries and consult your order history ;
  • return or exchange Products;
  • add or modify your delivery and billing addresses for future orders;
  • manage your PARESSE PARIS newsletter subscriptions.

Unless the customer provides proof to the contrary, the data recorded by the Site constitutes proof of the nature, content and date of all transactions between PARESSE PARIS and its customers. In the event of a dispute between PARESSE PARIS and one of its customers concerning a transaction carried out on the Site, the data recorded by PARESSE PARIS shall be considered valid proof of the content of the transaction, unless the customer provides proof to the contrary.

You can have your account deactivated at any time by sending an e-mail to Customer Services by clicking on the “Contact us” link.

5.2. Validation of orders placed on the Site

5.2.a) Validating the delivery method

You will need to validate your delivery method and complete the delivery information required for your order to be dispatched: country of dispatch, title, first name, surname, telephone number, delivery address and any other information required to process your order.

Once this step is complete, click on “Continue”.

5.2.b) Order payment confirmation

You can use your delivery address as your billing address, or enter a different one. You will then be asked to select a payment method (see Article “6. Prices – Accepted payment methods”) and to enter the relevant information.

At the end of the order process described above, and after having accepted the present General Terms and Conditions of Sale and Use and the Site’s Privacy Policy in their entirety, click on the “Pay” button.

To confirm a pre-ordered product, a personalized product or any other product requiring a longer delivery time, you must also authorize PARESSE PARIS to save your bank details until the product is dispatched and for a maximum period of 2 months, in order to debit your account when your order is dispatched.

You must check the accuracy of your selection before confirming your order. While every effort is made to ensure that the color and design of the Products whose photos are displayed on the Site are faithful to the original Products, variations may occur, notably due to the technical limitations of color rendering on your computer equipment. PARESSE PARIS cannot be held responsible for errors or non-substantial inaccuracies in the photographs or graphic representations of the Products shown on the Site. If you have any questions about the Products, please contact our Customer Service Department.

For more information on payment methods (currencies, accepted payment methods, etc.), please refer to the section below entitled “6. Prices – Accepted payment methods”.

Once completed, your order is sent to PARESSE PARIS for processing. The sales contract will be formed once we have received your order. We will proceed with the shipment of your Product subject to the availability of the purchased Product (as provided above) and the effective payment of the Product.

PARESSE PARIS reserves the right not to accept an order from a customer with whom it is in dispute over a previous order, or if PARESSE PARIS reasonably believes that the customer has breached these Terms and Conditions or engaged in fraudulent activity, or for any other legitimate reason.

5.2.c) Order summary

A summary of your order will then be sent to you by e-mail (“Your PARESSE PARIS order”). This summary will show the total amount of the order, information about the cost and delivery time, the essential characteristics, quantity and price of the Products purchased.

We recommend that you keep this summary in electronic form.

You will then receive an e-mail confirming shipment of your order, with your electronic invoice attached.

We do our utmost to ensure that you receive our communications as quickly as possible.

We advise you to check your “Spam” folder if you have not received the dispatch confirmation e-mail.

In application of article L213-1 of the French Consumer Code, when an order is for an amount equal to or greater than 120 Euros, PARESSE PARIS keeps the written record of the contract concluded between PARESSE PARIS and a customer by electronic means for a period running from the conclusion of the contract to the date of delivery of the goods and for a period of ten years thereafter (in compliance with decree 2005-137 of February 16, 2005). You can then access this document at any time, on request to the Customer Service Department after providing proof of your identity.

 

5.3. Ordering by telephone

You can order a Product by calling our Customer Service (see section “3. Ordering”). To place an order, you will need to provide the following information (“Order details”):

Product information: the name and/or reference number of the product requested, the quantity required and, if applicable, the color, size, material, finish and any other identifying information we require; and

Personal data: your title, first name, surname, telephone number, e-mail address, delivery address and, if applicable, billing address.

We will let you know if the requested Product is available and, if so, the purchase price of the Product, the estimated collection or delivery date and any delivery charges. Please ensure that the delivery information you provide is correct. Incorrect information may result in the delay or loss of your order. PARESSE PARIS will not be responsible for replacement or refund if the information you have provided is incorrect.

If you choose to proceed with the order, you will receive an e-mail or text message (depending on the chosen method of communication) containing a link to an external payment platform. Simply click on the link to be redirected to the payment platform where you will find details of the order and purchase price (“Order Information”). Before making the payment, you must check the accuracy of the Order Information. The payment link will be valid 30 minutes after sending.

Concerning the accepted method of payment, please refer to article 6 “Prices – Accepted methods of payment”, it being specified that we are unable to accept PayPal and Apple Pay payments for telephone orders.

Once you have confirmed the order details, provided and accepted these General Terms and Conditions of Sale and our Privacy Policy, you can proceed to the payment of the order by clicking on the “Pay” button. PARESSE PARIS will not have access to any bank details.

Once payment has been made, you will receive an order summary. We recommend that you keep this e-mail. PARESSE PARIS will then process your order.

The sales contract will be formed once you have placed your order. We will ship your Product subject to the availability of the purchased Product (as provided in Article 4) and the actual payment for the Product.  You will receive a shipping confirmation email when your order is shipped.

The Order Information collected by PARESSE PARIS constitutes proof of all transactions between PARESSE PARIS and its customers. In the event of a dispute between PARESSE PARIS and one of its customers concerning a transaction carried out on the Site, the Order Information collected by PARESSE PARIS shall be considered as irrefutable proof of the content of the transaction.

5.4. Invoices

Your invoice will be sent by PARESSE PARIS in a shipment confirmation e-mail. We make every effort to ensure that our communications reach you in a timely manner. However, it is possible that some e-mails may be classified as spam. We therefore advise you to check your spam folder if you have not received your shipping confirmation e-mail.

You can also download your electronic invoices in the “Your orders” section of your personal account. A customer account is automatically created for each order. To access your e-invoices, you need to log in to your account. If you have never logged in before, you can click on the account confirmation email to create a password, or you can create a password directly on the site by clicking on “forgot password”.

If you would like to receive a printed version of your invoice, please contact our Customer Service Department within one (1) month of dispatch of your order.

 

6. Prices - Accepted Payment Methods

6.1. Prices

For deliveries within the European Union, Product prices are indicated in Euros, all taxes included. Except in the case of reimbursements made (i) when exercising the right of withdrawal or (ii) for lack of conformity or hidden defects, PARESSE PARIS will not reimburse the VAT applied to purchases made on the Site (even if the purchaser, after receipt, ships the Products back to a third country).

For deliveries outside the EU, product prices are indicated either in Euro or in the local currency. Taxes are not included.

Products are invoiced on the basis of the prices displayed on the Site at the time your order is placed, subject to availability.

All orders are payable in Euros and must be paid for at the time the order is placed. In the event of unavailability of certain Products ordered (see Article 4 "Product availability"), only the price and shipping costs relating to the Products available will be debited.

 

6.2. Accepted means of payment

6.2.a) Payment by credit or debit card

The following credit and debit cards are accepted: Visa®, MasterCard®, American Express®, Carte Bleue®. Credit card payments are authenticated and secured by the 3D Secure system. This system is also known as "Verified by Visa®", "MasterCard® SecureCode" or "American Express SafeKey®". During payment, the bank requests personal information from the Internet user to verify the cardholder's identity and validate the transaction.

How do I pay with 3D Secure on paresseparis.com?

Once you have validated your bank details (card number, expiry date and cryptogram), a new page will be displayed on which you will be asked to enter the personal information requested by your bank. This information can be :

  • the answer to a personal question;
  • a password that you have chosen beforehand ;
  • a code sent by SMS,
  • your date of birth...

Once the 3D Secure code has been entered and validated by your bank, your order is finalized. You will then receive a confirmation e-mail.

Authentication is specific to each bank. If you have any questions about your 3D Secure code, please contact your bank directly.

Your order will only be dispatched once we have verified your payment method and received authorization to debit your card. Your account will be debited when your order is dispatched.

6.2.b) Payment by Paypal

We accept payment via Paypal (except for telephone orders, pre-orders and custom orders).

If you choose the Paypal payment option, you will be automatically redirected to the Paypal platform. If you do not have a PayPal account, you can create one at this time. After validating your order with Paypal, you will be redirected to the paresseparis.com confirmation page.

6.2.c) Payment by Apple Pay

We accept payments made by Apple Pay (except for telephone orders, in the case of exchanges).  This payment method is available from Apple devices on which you have entered your information in the Apple Pay payment application.

When you select "add to cart", the Apple Pay option appears on the page of the added product. You will need to select the Apple Pay payment option and then accept (i) the PARESSE PARIS General Terms and Conditions of Sale, (ii) that a customer account is automatically created if you do not have one, using the information you have entered in your Apple account, as well as the PARESSE PARIS Privacy Policy.

Please check that your Apple account information is correct, particularly the delivery address, before confirming your payment. PARESSE PARIS will not be responsible for the replacement or refund of the product if the information provided on your Apple account is incorrect.

Next, you'll need to confirm your order using Touch ID or by entering your Apple account ID and password.

After validating your order, you will be redirected to the paresseparis.com confirmation page.

If you have a PARESSE PARIS customer account, your order will be linked directly to your account.

If you do not have a PARESSE PARIS customer account, you will receive an email confirming the creation of your account. You will then be offered a link to personalize your customer account password.

6.2.d) Vouchers and gift cards

Credit notes issued by PARESSE PARIS and/or gift cards issued by PARESSE PARIS can only be used to purchase Products presented on the Site.

 

7. Reservation of title

The Products ordered remain the property of PARESSE PARIS until full payment has been received by PARESSE PARIS.

On the other hand, you assume the risks (in particular of loss, theft or deterioration) associated with the Products delivered as from their delivery to the address indicated at the time of the order.

 

8. Delivery Terms and Conditions

8.1. Delivery area

Please select the country of delivery when visiting our online store (hereinafter the “Delivery Zone”).

It is impossible to place an order for any delivery address outside this Delivery Zone.

For security and other reasons, PARESSE PARIS will not process orders for which a poste restante or P.O. box address is provided. Deliveries to forwarding companies are excluded.

Products are shipped to the delivery address you provided during the order process.

We reserve the right to ask for a signature and valid proof of identity on delivery (e.g. passport or driver's license).

For CHRONOPOST shipments, delivery must be made on presentation of a secure 6-digit code to be given to the delivery driver on the day of delivery. Without this code, the deliveryman will not be able to give the parcel to the addressee, and it will be left at a collection point.

8.2. Delivery charges

Delivery charges can be calculated at any time during your purchase. They are calculated according to the weight of the items and their destination.

8.3. Delivery times and terms

When you place your order, we will inform you of the delivery time, which will be confirmed in the order dispatch confirmation. The delivery time indicated below runs from the time your order is dispatched by e-mail. This time may be extended in exceptional circumstances.

Any order placed on a non-business day will postpone delivery until the next business day.

PARESSE PARIS reserves the right to split deliveries. In this case, your credit or debit card will be debited in the same way to correspond to the price of the Products actually dispatched and transport costs will only be invoiced for a single shipment in accordance with the information given in your order summary.

Orders including a customized Product are subject to specific delivery times, which will be communicated at the time of the order.

PARESSE PARIS will do its utmost to meet the delivery deadlines specified below. In the event of an event beyond our control leading to a delay in delivery, we will inform you as soon as possible. You may either request a new delivery date or cancel your order and receive a refund.

Any change to the delivery terms must be made via the application provided or our carrier's website. Failing this, PARESSE PARIS cannot be held responsible in the event of non-compliance with the delivery terms set out below.

PARESSE PARIS shall not be held liable in the event of failure to meet deadlines (late delivery, impossibility of delivery, return of Products to PARESSE PARIS, etc.) resulting from the erroneous and/or incomplete nature of the information provided by you for delivery and/or your absence at the time of delivery.

 

9. Delivery Problems

Any failure or delay in delivery, or in making your Products available in store, exceeding the delivery times mentioned in article 8.3 must be reported to our Customer Service as soon as possible.

In the event of failure to meet the delivery deadline, you may give PARESSE PARIS formal notice to proceed with delivery within a reasonable additional period. If delivery is not made within this additional period, you may cancel the order in writing. However, in the event of non-compliance with the delivery deadline, you may immediately cancel the order without further delay, in accordance with article L. 216-6 of the French Consumer Code, if you have indicated to us that compliance with the delivery deadline is an essential condition of your purchase. 

PARESSE PARIS will then be obliged to reimburse all sums paid, at the latest within fourteen (14) days of the date of cancellation of the sales contract. If you nevertheless receive the Product after having exercised this option, you must return it in accordance with the return procedure set out in article 11 below.

You must check the conformity of the Products at the time of delivery and indicate, if possible on the delivery note, in the form of handwritten reservations accompanied by your signature, any anomalies noted (open package, damaged product, etc.).

You must then contact Customer Services (see Article 3). In the event of non-conformity of the Products purchased or if you are not satisfied with them, you may return them or request an exchange or refund under the conditions set out in Articles 10 "Right of withdrawal" and 11 "Conditions of return, exchange and refund".

In the case of a CHRONOPOST delivery, it must be hand-delivered on presentation of a 6-digit PIN code. The secure code must never be communicated remotely to the driver in charge of your parcel.

 

10. Right of Withdrawal

10.1. Right and period of withdrawal

You have a legal right of withdrawal that you can exercise under the conditions set out in articles L221-18 and L221-20 of the French Consumer Code, if you meet the conditions set out in these provisions, without having to justify your decision or pay any penalties.

PARESSE PARIS' general return policy (for refund or exchange) allows you to cancel your order within fourteen (14) days from the date of delivery of the Products, without having to justify your reasons and without having to pay any penalty. Once this period has elapsed, you will no longer be able to exercise your right of withdrawal.

10.2. How to exercise the right of withdrawal

We offer you the possibility to fill in and send your declaration of withdrawal online by logging into your customer account. You will then receive immediate confirmation of your withdrawal by e-mail.

You can also send your cancellation request by contacting our Customer Service or by using the model cancellation form available in the appendix to these General Terms and Conditions of Sale.

10.3 Restriction of the right of withdrawal

In accordance with article L. 221-28 of the French Consumer Code, your right of withdrawal cannot be exercised for orders for (i) products that have been opened, unsealed or used (including when the outer transparent film has been removed), for reasons of hygiene, or for (ii) personalized products.

10.4 Consequences of the right of withdrawal

When exercising your right of withdrawal or in the event of non-conformity of the Product, you may return the Product(s) purchased and request an exchange or refund under the conditions described in article 11 below.

 

11. Return, Exchange and Refund Policy

11.1. With the paresseparis.com website

11.1.a) Return procedure

Products must be returned from a country within the Delivery Zone and in accordance with the procedures set out below. PARESSE PARIS shall not be liable for any loss, damage and/or delay relating to returns made from a country outside the Delivery Zone (cf. article 8.1) and/or which do not comply with the following terms and conditions.

Any additional costs (taxes and/or customs duties) and/or customs clearance formalities for a return from a country outside the Delivery Zone will be borne exclusively by you.

When exercising the right of withdrawal, Products must be returned in their original condition and packaging (gift box and shipping carton), accompanied by their purchase invoice or a copy in the case of partial returns.

To arrange the return of your Product, please contact our Customer Service Department.

 

11.1.b) Exchange

In the event of an exchange request, please specify in the dedicated field the Product(s) you wish to receive in exchange for your order.

If you would like your chosen product(s) to be set aside for you, please contact our Customer Service Department.

If the amount of the Product(s) chosen as a replacement is greater than the amount of the Product(s) returned, you will be required to pay the price difference by credit card using our secure payment service. Please note that we are unable to accept PayPal and Apple Pay for the payment of any price difference following an exchange.

If the value of the Product(s) chosen as a replacement is less than the value of the Product(s) returned, PARESSE PARIS will reimburse the difference in price (remember that for gifts, only the customer who purchased the gift can request reimbursement and have his/her bank account credited).

Please note that the exchange will take place within seventy-two (72) working hours of receipt of the product(s).

As an exception to the above, no exchanges of personalized products will be made.

11.1.c) Refunds

In the event of a refund request, the refund will be made immediately upon receipt of the Product(s). A confirmation e-mail will be sent to you. The refund, including the delivery costs of the original order, will be made using the same method of payment used for the order, and in the same currency as that used to pay for the order.

Please note, however, that your bank may take up to ten (10) business days to issue a refund to your card, depending on processing times. This varies from card issuer to card issuer, and PARESSE PARIS is unable to expedite this process beyond our control.

11.1.d) Gifts ordered from the Site

Third-party recipients of gifts ordered from the Site may only exchange the Products via the Site's returns procedure. Consequently, only the customer who purchased the gift will be able to request reimbursement within the framework of the right of retraction (insofar as only the bank account of the person who ordered the product can be re-credited).

In this case, only an exchange for a Product of equivalent or greater value (the difference in price must then be paid by the third party recipient of the gift) is possible. The third-party recipient must contact our Customer Service department, which will register the exchange and send the prepaid return label by e-mail.

11.1.e) Return, exchange and refund conditions for orders paid with PayPal

In the event of a request to exchange an order paid with PayPal, your bank or credit card details will be required if the amount of the new order is greater than the amount of the initial order.  Any amount over and above the amount of the original order can only be paid by credit card. We are unable to accept payment by PayPal for the additional amount due for an exchange order. If the amount of the new order is equal to the amount of the original order, you will not need to provide your credit card information and no new payment will be required.

If you request a refund for an order paid by Paypal, your PayPal account will be credited with the amount of the original order.

11.1.f) Return, exchange and refund conditions for orders paid with Apple Pay

In the event of a request to exchange an order paid for with Apple Pay, and if the amount of the new order is greater than the amount of the original order, only credit card payments will be accepted. Your credit card details will be required on the payment platform.

If you request a partial or full refund for an order paid by Apple Pay, your Apple Pay account will be credited with the amount of the original order.

 

12. Legal and commercial warranties

12.1. Legal warranties

Products sold by PARESSE PARIS are subject to the legal warranties set out in articles L217-4 to L217-14 of the French Consumer Code and articles 1641 to 1648 of the French Civil Code, to the exclusion of all other warranties:

These legal warranties apply independently of the commercial warranty referred to in article 12.2.

Legal warranty of conformity (L217-4 to L217-14 of the French Consumer Code) :

  • PARESSE PARIS will deliver to you a Product which conforms to the contract and is free from defects in conformity at the time of delivery of said Product, in the sense that the Product will be fit for the use normally expected of a similar good and will have the characteristics described at the time of sale. PARESSE PARIS shall also be liable for any lack of conformity resulting from the packaging, assembly instructions or installation when the latter is the responsibility of PARESSE PARIS under the contract or has been carried out under its responsibility. This warranty will only apply if you request it within two years of delivery of the goods. Defects of conformity which appear within twenty-four (24) months of delivery are presumed to have existed at the time of delivery, unless proven otherwise.
  • You may choose between repairing or replacing the Product, unless one of these options is impossible or would entail a manifestly disproportionate cost for PARESSE PARIS, in which case PARESSE PARIS may choose the other solution. In addition, in the event of a serious lack of conformity, you may have the price paid refunded and return the Product or keep the Product and have part of the price refunded. The repair, replacement or refund of the Product will be free of charge to you and does not preclude the possible award of damages should you be entitled to them.

Legal warranty against hidden defects (art. 1641 to 1648 of the French Civil Code) :

  • PARESSE PARIS will deliver to you a Product free from latent defects which render it unfit for its intended use, or which so diminish that use that you would not have purchased it, or would only have paid a lesser price for it, had you been aware of them. This warranty will only apply if you make a claim within two (2) years of the discovery of the defect, and in any event within five (5) years of the date of purchase.
  • In the event of a latent defect, you will have the choice of returning the Product and having the price and costs of the sale refunded to you, or keeping the Product and having part of the price refunded to you. In all cases, it is up to you to prove that you meet the warranty conditions.
  • In the event of lack of conformity or hidden defects, you must return the Products to PARESSE PARIS by contacting our Customer Service Department. 

12.2 Commercial warranty

Certain Products sold on the Site benefit from a commercial warranty in addition to the legal warranties referred to in the previous article. The content and terms of this commercial warranty are available on the Site in the "Contact us" tab and in the FAQ section linked to our Products. You can view these terms before purchasing any Product concerned by this warranty.

 

13. After-sales service and spare parts availability

All technically repairable products are covered by an after-sales service. For all repairs, please contact our Customer Service Department.

In accordance with article L 111-3 al 1 of the French Consumer Code, PARESSE PARIS confirms that no period of availability of spare parts essential to the use of the Products is guaranteed. PARESSE PARIS will nevertheless make its best efforts to satisfy its Customers in the event of a request for one or more spare parts.

 

14. Limitation Of Liability

Under no circumstances may PARESSE PARIS be held liable for any damage not resulting from a breach by PARESSE PARIS of one of its obligations.

 

15. Applicable law - Disputes

These General Terms and Conditions of Sale are governed by and construed in accordance with French law. In the event of a dispute relating to the application and/or interpretation of these General Terms and Conditions of Sale, you may contact our Customer Service Department (see Article 3). You may also have recourse to a conventional mediation procedure or any other alternative dispute resolution procedure. In accordance with order no. 2015-1033 of August 20, 2015 and implementing decree no. 2015-1382 of October 30, 2015, any so-called consumer dispute or litigation, subject to article L612-2 of the French Consumer Code, may be settled out of court by mediation with the CMAP - Centre de Médiation et d'Arbitrage de Paris. To submit a dispute to the mediator, the customer may (i) fill in the form on the CMAP website: www.cmap.fr tab "vous êtes: un consommateur" (ii) send his request by ordinary or registered post to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to consommation@cmap.fr. Whichever method you use to contact CMAP, your request must contain the following elements in order to be processed rapidly: your postal, email and telephone contact details, as well as the full name and address of PARESSE PARIS, a brief statement of the facts, and proof of prior contact with PARESSE PARIS.

In the event of a dispute relating to the execution of an order, if you are an individual end consumer, you have the possibility of resorting free of charge to a conventional mediation procedure or any other alternative dispute resolution procedure.  If you wish, you can use the online dispute resolution service offered by the European Commission in accordance with Article 14 of Regulation (EU) No. 524/2013. This platform can be accessed at the following address: https://webgate.ec.europa.eu/odr/. Recourse to mediation is an alternative mechanism that is not a prerequisite for legal action.

In accordance with article L. 223-1 of the French Consumer Code, you have the option of registering free of charge on a Bloctel telephone anti-solicitation list (www.bloctel.gouv.fr) so that you are no longer contacted by telephone by a professional, except in the case of solicitations made in connection with the performance of a current contract and related to the purpose of that contract.
